Booking Terms and Conditions

 

1.Contract of Hire: Somos Rentals act as the Agent for the holiday home Owner. The Contract is between the Owner and the person making the booking (the Guest).

When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us or between you and the owner.

A contract with the owner shall only arise when your booking is subsequently confirmed in writing via a booking confirmation sent to you by email. By clicking the online "accept" button you agree to all of the Booking Conditions and Terms listed here without exception.

By completing and submitting the electronic booking form you are making an offer to rent a holiday property which, if accepted by us, will result in a binding contract between you and the property owner.

Somos Rentals has the right to rescind the contract before or during the rental period if unforeseeable or unavoidable circumstances make it impossible to hand over the rental property, endanger the hirer or the property or impair the provision of services to such an extent that it is no longer reasonable to fulfil the contract. 

Minimum Age: The main guest named hiring this property must be over 25 years old.

 

2. Changes: Changes to the booking agreement and deviations from these general rental conditions will be valid only if agreed in writing between the landlord and Somos Rentals and the Guest. Insofar as changes that result in higher or lower costs, the resulting change to the rent must be agreed by parties in writing.

 

3. Payment: Bookings can be made via the internet, in writing, by telephone, by e-mail or personally with Somos Rentals.

All payments must be made in euros. A deposit of not less than 20% of the total rental is payable at the time of booking. If the deposit is not received in our client account within 5 working days, the reservation will expire, and the guests are no longer entitled to the property.

The final balance including the security deposit is payable 4 weeks prior to the holiday move in date. Where the booking is made within 4 weeks of the holiday date, full payment is required with booking.

If these payment terms are not observed, Somos Rentals are entitled to cancel the booking without having to refund the payments that have already been made. Reservation deposits will be refunded only if the booking cannot be honoured due to a cause attributable to the landlord or booking agent.

 

4. Prices:

Prices are stated in Euro per property per week or per day. The property price includes, electricity, water, gas, air conditioning, internet, bed linen and bath towels for each guest. 

The final cleaning charge does not include tidying up after guests, and guests should leave the villa in the same condition as when they arrived. Please see the section Duration of Stay, Arrival and Departure below for reasons that extra funds for cleaning will be deducted from your security deposit.

Our cleaning charges include VAT at the current rate. The prices are correct and valid at the time of booking.

THE TOTAL PRICE OF EACH RENTAL INCLUDES THE PROPERTY PRICE, DEPARTURE CLEANING, BED LINEN AND BATH TOWELS AND ANY EXTRAS THAT HAVE BEEN REQUESTED. 

The agents reserve the right to change prices according to costs. We will not however change the price of your accommodation, final cleaning or air-conditioning after booking and confirmation. We do not accept responsibility for typographical errors in the brochure or pricelist. 

 

5. Dissolution: The agreement will be dissolved (i.e. The booking will be cancelled) if the Guest fails to satisfy the provisions of clause 2. The deposit will be forfeited to defray incurred costs and damage, including but not confined to loss of profits.

 

6. Cancellation: If the Guest needs or wants to cancel a booking they must inform Somos Rentals immediately in writing to bookings@somosrentals.com.

If advised before the date of the final payment, the booking will be cancelled without extra penalty, and the reservation deposit will be paid to the owner as compensation. If the full booking amount has been paid and the Guest cancels the booking within four weeks of the arrival date, unless due to death or serious illness, the full booking amount will be paid to the owner as compensation less agency fees.    

If the final payment has been paid or due the property will be re-advertised and re-let where possible, if this is successful, a refund to the value of the re-booking will be made less an admin fee of 100€ and the reservation deposit which is not refundable in any circumstances.

No refund will be given for any reason including any COVID related cancellations as long as Somos Rentals and the villa are legally available to accommodate the guests, this includes any cancellations due to travel cancellations or restrictions imposed by the guest’s own country for travelling to and from Spain.

Somos Rentals expects all guests to take out the relevant travel insurance required. 

Where the circumstances of the cancellation do not meet the above criteria, no refund will be payable, you must still notify the Agent as soon as possible if you do not intend to take your holiday. 

The deposit paid is non refundable in any event.

 

7. Insurances: The rent excludes insurances for the Guest or their belongings. Somos Rentals can inform you of possibilities for taking out travel and/or cancellation insurance. We recommend that you take out holiday cancellation insurance which will normally reimburse you if the reason for the cancellation is within the terms of the policy.

 

8. Liability of Landlord: Under no circumstances whatsoever will Somos Rentals or landlord be responsible for any loss or loss of value and/or damage to property of the Guest and their co-occupants caused by incorrect use of the rented property. If the Guest incurs damage due to deficiencies in the rented property, any liability on the part of the landlord will be limited to the rent. Damage resulting from non-fulfilment by the landlord will be subject to the              compensation provided for by law. The landlord will not be liable for any other damage.

 

9. Liability of the Guest: a Guest who books accommodation for or jointly on behalf of other occupants will be jointly and severally liable for the total rent and for damage caused by acts by them and all others present with them in the rented accommodation. A booking will be valid for the number of persons stated on the booking form. The property may not be occupied by more persons than stated on the booking form. Occupancy by a larger number may result in dissolution of the booking agreement and loss of the deposit. Payments already made will not be refunded in such circumstances and the Guest will owe the entire rent. If the Guest intends to allow more than the permitted number of persons to stay in the rented accommodation, the renter must, prior to the rental period, submit a written request to this effect to the booking agent. The accommodation provider has the right to refuse such a request or to require an additional surcharge. The Guest must treat the accommodation according to generally accepted standards and vacate the property in a clean condition. 

 

10. Security Deposit: The security deposit is payable along with your final payment for the accommodation. The security deposit will be returned not later than 14 days after the end of the rental.

In the event of damage and/or loss of the rented property, and/or circumstances for which the Guest is to blame, the total incurred damage will be deducted from the deposit. In all instances where the costs of damage and/or loss of the rented property or the damage incurred by the owner and/or accommodation provider exceed the paid deposit the Guest must immediately pay the excess to the accommodation provider. All instances of breakages, loss and/or damages must be reported immediately to the accommodation provider and paid for.

When refunded the security deposit, any costs for transfer fees will be assumed by the Guest.

 

11. Duration of Stay, Arrival and Departure: The minimum stay is five days or seven days in July and August as a rule unless stated otherwise. The customary arrival and departure days may vary according to location. Outside the high season it is generally possible to choose any day of the week as the arrival or departure day.

The check-in time will be from 16.00 hrs unless we confirm otherwise. If the property is ready before 16.00, we will notify you. The keys will be left in a keybox located at or near the property. Clear instructions will be sent to you with the property address, GPS location and the keybox code. This allows guests to arrive at their own time whatever the hour.

In the event that you require a personal meet and greet service from a member of staff, there will be an additional charge of 20€ between the hours of 18.00 and 22.00, whilst guests arriving after 22.00, on a Sunday or Bank Holiday will be charged 40€. This is payable in cash separately.

On the day of departure, you must vacate the accommodation before 10.00 hrs. Failure to do so gives the accommodation provider and landlord the right to charge you a penalty for the delay. You may lose your security deposit as a result.

The Guest is responsible for leaving the property clean and tidy and for any loss, breakage or damage. Any awnings, umbrellas or soft furnishing outside must be retracted, closed and stored indoors or covered terrace if possible, during any poor weather.

Any breakage or damage, however minor, must be reported immediately by the Guest to the Agent, who will make the appropriate charge for repair or replacement. 

The Guest will be responsible for the cost of any extra cleaning that may be required; this includes cleaning of oven and ovenware, microwave ovens, cleaning of BBQ's, removal of rubbish not disposed of before departure. Crockery should be washed and stored in the appropriate place. The items in and around the accommodation should be put back in their original location (as upon arrival). Any general tidying and removing litter left in bedrooms, kitchens, cleaning of used equipment etc will all be charged for. 

All Air conditioning or heating is to be turned off when you leave the villa or go outside of the villa. All windows and doors must be closed whilst using the air conditioning or heating. Duvets or blankets must not be used during the hotter weather in Summer / Autumn with the air conditioning being used, as they are not necessary. Any abuse of the use of air conditioning or heating can result in extra payment being deducted from your security deposit.

Furniture must NOT be moved outside from inside the property under any circumstances as this could lead to sun damage, any furniture inside the property moved during the guest stay MUST be moved back to its original position before the guest vacates the property.

 

12. Changes and Cancellations: The renter has the right to alter or cancel the agreed services in any material respect on account of compelling circumstances. Compelling circumstances mean circumstances of such a nature that the accommodation provider cannot reasonably be held to further fulfilment of the agreement. The accommodation provider may cancel the     booking in the event will be under obligation to refund any amounts already paid. The accommodation provider reserves the right to replace the rented property by an equivalent property for reasons of quality assurance.

 

13. Complaints:  

The Guest must take up any complaint immediately with Somos Rentals on behalf of the owner, who will liaise with the owner, and must be afforded the opportunity to address the issue raised.

The Agent regrets that it cannot take up a complaint after the Guest has vacated the property. Neither the Owner nor the Agent will be reliable for any additional costs incurred or claimed by a Guest should he / she decide to vacate the property prior to the booked departure date.

 

14. Cleaning Costs: The cleaning costs will be specified together with the rental price on the booking form. These costs are payable to the Somos Rentals with the balance of the accommodation. The departure clean includes a general clean of the floors, kitchen, bathrooms, furniture surfaces, outside spaces and terraces.

 

15. Bed Linen and Towels: Bed linen and towels are included the rental price. We advise you to take your beach towel with you.

 

16. Extra Facilities: Guests can request a child’s cot, high chair, push chair or stairgate which will show as an additional cost on their statement. These can be added before your arrival if you contact us at least two working days before your arrival.

 

17. Pets: Pets are accepted only where indicated and provided that they are not left unattended at any time, they are not allowed on the furniture, nor in the bedrooms and that any pet hairs in the property and fouling in the grounds are removed before departure. Any pet (s) in the party must be declared in the comments at the time of booking and the additional charge paid. The pet stay and charge will be confirmed on the booking form.  

 

18. Construction Work: The properties depicted in our publicity and website are private properties that belong to various owners and are typically located in large residential districts. The properties are not located in holiday parks, so construction work may occasionally occur nearby. This work is carried out by homeowners or contractors with whom we have no relationship whatsoever and over whom we cannot exert any control. Neither the accommodation provider nor our organisation can be held liable for inconvenience caused by any construction work not commissioned by the accommodation provider.

 

19. International & Satellite TV: Where descriptions refer to international channels or satellite TV, it does not automatically mean that reception includes all stations. The mostly foreign owners have decoders that are not always suitable for receiving English stations. Any faults or loss in signal for these channels are out of our control and therefore we cannot offer any compensation if certain or all channels fail to work correctly.

 

20. Water and Electricity: Interruptions to water and electricity supplies are not uncommon in southern European countries. For various reasons municipal and/or regional authorities may decide temporarily to disconnect or reduce distribution. Neither your accommodation provider nor our organisation can be held liable for any damage incurred through such circumstances.

 

21. Power Consumption: A mandatory weekly surcharge may sometimes be payable in certain seasons for properties with heating and/or air conditioning. For more detailed information and the amounts payable, you should view the property details stated on the website, or contact Somos Rentals.

 

22. Use of the Pool: Only the people named in the guest list of this contract can use the community or private pool of the property. Guests are asked to apply sun lotion at least 30 minutes before entering the pool to avoid water contamination that can lead to loss of use for several days. Food and drinks should be consumed away from the pool and glass is prohibited in the vicinity. Failure to adhere to these guidelines may result in partial or total loss of the security deposit as compensation to the owner, depending on the severity of the situation.

 

23. Payment Protection: All money paid to the accommodation provider will be held in a customer account. Funds will only be released from this account to owners once the reservation period has started.

 

24. Please note: The accommodation provider reserves the right to change a reservation to an alternative accommodation of an equivalent standard should this become necessary due to unforeseeable circumstances.

25. Jurisdiction and Law: Notwithstanding the legal rules governing the jurisdiction of the civil courts, any dispute arising    between supplier and principal or client will be resolved by a court of law with jurisdiction in the country and region where the landlord is established. For one month after the landlord has invoked this provision in writing, the renter will have the right to opt for resolution of the dispute by a civil court with jurisdiction at law or under international treaty. The landlord will consider the address stated by the renter to be correct until further notice. Every agreement between landlord and renter will be subject to European law.

 

26. Reservation Agent: Somos Rentals is the commercial name of a real estate agency managed by Dayse Trujillo Pajuelo with NIF 49762159-A and located in Parque Guadalquivir 2, San Fulgencio, 03177, Alicante. Your accommodation contract is with the individual owners, who are represented by the booking agents Somos Rentals, who also act as the property managing agents.

 

Definitions

 

1. Accommodation: Place where a person is temporarily staying.

 

2. Accommodation Provider: Somos Rentals, the party who actually provides the booked accommodation and further arranges services locally, such as key-holding, cleaning, maintenance, etc., and receives payments payable locally by the Guest under the agreed booking.

 

3. Landlord: the owner of the property that employs Somos Rentals to manage the property and the rentals for them.

 

4. Guest: the person named on the booking form who makes the booking.

 

5. Rent: The amount paid for the accommodation during a set period.

 

6. Booking: Reservation made for an accommodation for a certain date.

 

7. Security Deposit: Amount of money that is given to ensure the fulfilment of an obligation.
